Nov. 8 Election Day Recall Petition Signature Drive

On Tues., Nov. 8, sign on to enacting term limits, aligning elections and recalling Morgantown City Council. Stop by 280 Eureka Drive near Precinct 16 from 6:30 AM-7:30 PM.

A signature drive will be held from 6:30 a.m. – 7:30 p.m. at 280 Eureka Drive, outside the 100-ft official no electioneering zone, near Morgantown’s Precinct 16 at the BOPARC Senior & Community Center at the historic Wiles Hill School. Stop by on your way or after you vote to sign to enact term limits, align election dates with a future general election in November, and recall any and or all of Morgantown’s City Council.

Since a citizen-led effort to recall all of Morgantown City Council launched in July, additional information has come to light that further supports taking action now to change local government before bad gets worse.

First, it was shown Morgantown City Council didn’t verify and hold City Manager Kim Haws accountable for not adhering to the Charter’s residency requirements beyond adding new contract stipulations. Since being hired and until brought to light by a citizen, Haws was accused of moonlighting and commuting to and from his home in Harrison County.

More troubling, Morgantown Mayor, Jenny Selin, has been accused by MUB Board Chair J.T. Straface of attempting to strongarm or “leverage” MUB to agree to improvements not consistent with MUB’s Flegal Dam & Reservoir in exchange for releasing the City’s committed share of $1 million dollars of federal American Rescue Plan Act (ARPA) funding to make storm water improvements on Stewart Street and Willowdale Road to mitigate Popenoe Run flooding issues.

Malfeasance

Malfeasance in office is the doing of an act for which there is no authority or warrant of law.

Misfeasance

Misfeasance is the wrongful and injurious exercise of lawful authority — that is, the doing of an act which might lawfully be done, but is done in an improper manner.

Nonfeasance

Nonfeasance is a term used in tort law to describe inaction that allows or results in harm to a person or to property. An act of nonfeasance can result in liability if (1) the actor owed a duty of care toward the injured person, (2) the actor failed to act on that duty, and (3) the failure to act resulted in injury.

While it’s tabled now, City Council may take up its MUB takeover later.

Three City Councilors: Bill Kawecki, Jenny Selin, and Dave Harshbarger were adamant about moving forward to restructure MUB. Shame on them! Ironically, these councilors have two more full years left in their term, which increases the importance of the recall effort to remove them now.

For now, the other four Councilmembers have tabled the issue, but pressure is inevitably being placed on the holdouts, and some, like Deputy Mayor Danielle Trumble, have expressed a desire to move forward.

No MUB customer is safe.

Whether you’re a MUB customer in Morgantown’s city limits or across the Mason-Dixon in Pennsylvania, know this is an attempt by Morgantown City Council to further enact its will upon your property and your life.

Don’t be lulled into complacency thinking the issue will go away. If past history tells us anything, City Council may still try to implement its misguided agenda fueled by obstience.
